All persons should know the meaning of the words conservatorship, conservator, and conservatee. It is vital to the protection of one's life, assets, and freedoms.
In California, a conservator of the person may be appointed for a person who is unable to provide properly for his or her personal needs for physical health, food, clothing or shelter. A conservator of the estate may be appointed for a person who is substantially unable to manage his or her own financial resources or resist fraud or undue influence. The person conserved is a conservatee. "Substantial inability may not be proved solely by isolated incidents of negligence or improvidence." CA Probate Code Sec. 1801.

Sometimes a conservatorship is necessary and beneficial; in that case, family members are favored by the law to act as conservator.


2 Isle banks could gain tens of millions from Visa's IPO

Hawai'i's two largest banks could gain tens of millions of dollars from Visa Inc.'s $17 billion public offering later this month.

According to a recent filing with the Securities and Exchange Commission, Bank of Hawaii Corp. owns 900,000 shares of restricted Visa stock, which it received last October as a member of the San Francisco-based credit card network.

First Hawaiian Bank also owns shares in Visa, but the privately held company did not disclose the size of its holdings.

Visa's March 19 public offering is expected to be the largest ever IPO in the country, with more than 406 million shares expected to be sold at a price between $37 and $42.

Allan Landon, Bank of Hawaii's chief executive officer, said the company plans to hold on to most of its shares but may have to redeem some stock.


Explorers piling up bills, businesses say

Local businesses say the Great Falls Explorers professional basketball team and team owner Michael Tuckman of Seattle are racking up more than points this season. They say Tuckman has between $40,000 and $50,000 in outstanding bills.

Tuckman said Monday night that he has outstanding bills with two Great Falls hotels but denied any responsibility for the other expenses, saying they were accrued prior to his taking ownership of the Explorers on Nov. 24 from Apex Sportstainment.

BHP boss dismisses China's Rio raid

BHP Billiton chief executive Marius Kloppers has brushed off Chinalco's share raid on Rio Tinto, saying the company's takeover can be completed without the support of the Chinese aluminium giant.

Describing Friday's share raid as an "interesting development", Mr Kloppers said the improved offer for Rio Tinto was "favourable" to the target's shareholders, including Chinalco. But Mr Kloppers was adamant the takeover could be completed without the support of Chinalco and its junior US partner in the raid, Alcoa. "By the terms of our offer, absolutely," he told told journalists during a conference call today. "I think the offer terms are very favourable to all the Rio Tinto shareholders, and indeed Chinalco as well," he added. China's state-owned Chinalco and Alcoa teamed to secure a 12 per cent stake in Rio Tinto's UK shares on Friday for $US14 billion ($15.63 billion).

Agreement For Colorstar Photo Kiosks At Chinese Netcafes

An American company has signed a deal to place retail photo kiosks in Chinese Internet cafes.

Northport Capital's Chinese subsidiary has signed an agreement with China Netcom for supply and operation of a total of 564 of Northport's Colorstar digital photo processing kiosk units. Three hundred Colorstar units will be installed in netcafe locations in Liaoning province that are supplied with ADSL connections from China Netcom. A further 264 units are to be installed in CNC retail locations in the province.

Revenues are split 15% to CNC and 85% to Northport with Northport paying monthly fees for Colorstar unit ADSL connections as well as a service cost. The agreement runs for two years after which the parties have the option to extend the agreement further. Ownership of the kiosk units remains with Northport.

Unlike native cottonwood trees, the plants also spread to upland areas.Some stands of trees near John Martin Reservoir are up to 1.5 miles wide.The Tamarisk Coalition estimates water losses in the watershed from tamarisk, above and beyond what native vegetation would use, is 76,600 acre-feet per year, or about the same amount needed by Aurora each year.If the problem is not addressed, future water losses from "infilling" (no expansion from existing infested areas) alone are estimated to be 198,000 acre-feet per year, or enough for Pueblo, Colorado Springs and Aurora combined.The mapping and survey project estimated it would take $70 million to completely eradicate and restore the watershed."This goal is a daunting undertaking in itself for a watershed to accomplish," Van Pelt said. "The solution may lie in developing partnerships to achieve this gargantuan goal."There are several efforts in place to control tamarisk, including the statewide Tamarisk Coalition, which provides education and outreach on the threat.Pending state legislation proposes a Colorado Water Conservation Board grant program to provide $4 million over the next four years to cost share with federal, local and private funds for tamarisk restoration projects.Federal legislation was passed in October 2006 to assist in rectifying the tamarisk problem.In the Arkansas watershed, several groups have formed, including: Bent County Tamarisk Working Partners, Conservation Partners Conquer Tamarisk, Tackling Tamarisk on the Purgatoire, Upper Arkansas Regional Weed Management Cooperative, Bent's Fort Project and local landowner groups.The Southeastern district and Bent County have assembled a collaboration of partners to fund and develop the Arkansas River Watershed Invasive Plants Plan for the watershed.
